By accessing and using FixThatCV ("Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Service. We reserve the right to modify these terms at any time, and your continued use of the Service constitutes acceptance of any changes.

FixThatCV provides AI-powered resume analysis and optimization services. Our Service analyzes your resume against job descriptions, provides ATS (Applicant Tracking System) compatibility scores, identifies missing keywords, and generates optimized resume content. We also offer job application tracking tools.

The Service operates on a credit-based system where each resume analysis consumes one credit. Credits are purchased through one-time payments and never expire.

To use our Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must be at least 18 years old to use this Service. By creating an account, you represent and warrant that you meet this age requirement.

Credit Packs: We offer three credit pack options: Starter Pack (10 credits), Pro Pack (25 credits), and Ultimate Pack (60 credits). Each resume analysis uses one credit.

Free Trial: New users receive 1 free credit to try the Service.

Payment Processing: Payments are processed securely through Paystack. All prices are listed in USD. By making a purchase, you agree to provide accurate payment information.

No Expiration: Credits never expire and can be used at any time after purchase.

No Refunds: All credit pack purchases are final and non-refundable, except as required by law or as stated in our satisfaction guarantee (see Section 5).

We offer a 7-day satisfaction guarantee for first-time users. If you are not satisfied with your first resume analysis, you may request a full refund within 7 days of your initial purchase by contacting our support team.

After using credits beyond the first analysis, refunds are evaluated on a case-by-case basis and are granted at our sole discretion.

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Upload content that contains viruses, malware, or harmful code
• Attempt to reverse engineer, decompile, or extract the source code of our AI models
• Share your account credentials with others or create multiple accounts to abuse free credits
• Use automated tools or bots to access the Service
• Upload resumes or content that you do not have the right to use
• Resell or redistribute our Service or analysis results without permission

Your Content: You retain all ownership rights to the resumes and content you upload. By uploading content, you grant us a limited license to process, analyze, and store your content solely for the purpose of providing the Service.

Our Content: The Service, including all software, algorithms, AI models, designs, text, graphics, and other content provided by FixThatCV, is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our content without explicit permission.

Analysis Results: The optimized resume content and analysis results generated by our Service are provided for your personal use. You may use these results to improve your own resume but may not resell or redistribute them.

No Guarantee of Results: While our AI-powered analysis is designed to improve your resume's ATS compatibility, we do not guarantee that using our Service will result in job interviews, job offers, or employment. Job search success depends on many factors beyond resume optimization.

Service Availability: We strive to provide continuous access to the Service but do not guarantee uninterrupted availability. We may temporarily suspend access for maintenance, updates, or unforeseen technical issues.

AI Limitations: Our AI analysis is based on patterns and best practices but may not be perfect. You are responsible for reviewing and verifying all optimized content before using it in job applications.

Third-Party Services: We use third-party services (such as payment processors and cloud storage providers) to operate the Service. We are not responsible for the performance or security of these third-party services.

To the maximum extent permitted by law, FixThatCV and its affiliates, officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or employment opportunities, arising from your use of the Service.

Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid for credits in the 12 months preceding the claim.

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy. By using the Service, you consent to our data practices as described in the Privacy Policy.

We comply with applicable data protection laws, including GDPR (General Data Protection Regulation) and POPIA (Protection of Personal Information Act).

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in fraudulent, abusive, or illegal activity. Upon termination, your access to the Service will be revoked, but any unused credits will remain valid for 30 days if you wish to resolve the issue.

You may terminate your account at any time by contacting our support team. Termination does not entitle you to a refund of unused credits unless otherwise stated.

These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the Arbitration Foundation of Southern Africa (AFSA), except where prohibited by law.

We reserve the right to modify these Terms at any time. We will notify users of significant changes by email or through a notice on the Service. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
